Moving out before expiry of the period of notice

There are many reasons why the regular termination date cannot be met. It’s good that there’s a solution. Are you planning to move out early? We will show you what you need to take into account.

Fundamentals

Early move-out and termination of the tenancy agreement before the contractually agreed notice period is possible under certain conditions. It is important to note that you remain liable for the payment of the rent until the regular termination date. 

First steps

First, check your tenancy agreement and the notice periods specified in it. Next, send us or your property manager the written notice of termination, preferably as early as possible and by registered post. Keep the postage receipt until you receive the termination confirmation.

Search for new tenants

As a tenant, you are obliged to propose at least one person for the subsequent tenancy to the property manager. This person must be acceptable, solvent and willing to accept the tenancy agreement on the same terms. Only then will you be released from your tenancy and from all liability. 

Before you advertise the apartment, you should discuss the responsibilities with your property manager. You can also clarify how prospective applicants who have already voiced an interest can apply. Livit, for example, has its own digital rental process. 

Viewing and form

Arrange viewing appointments with the interested parties as soon as possible. Ask the landlord about the application forms so that you can hand them out during property viewings. 

Do you live in a Livit property? Then you don’t have to deal with application forms, because the link to the digital application form will be sent to prospective applicants by e-mail. Please therefore send us the first and last names as well as the e-mail addresses of the persons you propose as the next tenants. Written confirmation

Would the interested parties like to apply? That’s great. Get confirmation in writing of their interest and their agreement to accept the existing terms and conditions by getting them to inform you of their application. 

Contact the landlord

If you do not receive any information from the property manager, it is best to inquire about the current status after a few days. 

Confirmation of release from the tenancy agreement 

If all parties agree and the tenancy agreement has been signed, you can ask the property manager for written confirmation that you have been released from the tenancy agreement and the corresponding liability, unless this is done automatically.
